Transparency Program – Introduction

Based on Article 7 of Law No. 119/2014 “On the Right to Information” (hereinafter “LDI”), The Public Authority (hereinafter “PA”) shall publish the Transparency Program (hereinafter ‘TP’) approved by the Commissioner for the Right to Information and Protection of Personal Data (hereinafter “the Commissioner”). The AP must publish information in accordance with its functional activities and must review and update the PT whenever there is a change in its institutional activities, the legal and regulatory framework, or any other element related to proactive transparency. The PT specifies the categories of information that must be made public. Public information without a request must be: complete, accurate, up-to-date, easy to consult, understandable, easily accessible, and consistent with the original documents in the possession of the A.P. Additionally, before publishing information, the A.P. must assess whether there are any legal restrictions on publication. Acts that contain rules, norms, or restrictions on the fundamental rights and freedoms of the individual, as well as those with direct effect on them, are made public by posting or publishing on the official website within 48 hours of the act's approval by the AP. The transparency program specifies the categories of information that must be made public, the method of publication, as well as the legal provisions from which the obligation to publish arises. In publishing information, AP must take public interest into account and enable easy access to public information.
